Andrej Babiš, the self-styled tycoon that secured victory in the recent Czech election, has declined to sell his extensive business interests, while asserting he will resolve a conflict of interest that could block him from taking the position of prime minister.

Position on Business Holdings

Babiš, whose ANO party emerged victorious in the October election but lacked a majority in parliament, declared in a social media post that he will not sell his Agrofert group, which operates in agriculture, food production, and chemical industries.

“I have consistently said I will not sell Agrofert. I have repeatedly stated I will address the conflict of interest in compliance with Czech and European laws,” Babiš remarked. “This is different from selling a pastry in a bakeshop.”

Head of State's Demand

The head of state, Petr Pavel, announced that the elderly political figure must publicly explain how he will remove ethical conflicts stemming from his business activities before assuming the role of premier.

The national charter “clearly mandates the president to consider the possible emergence of a ethical issue and the possibilities for its resolution” when selecting government ministers, Pavel's office explained.

The head of state “expects clarity in what specific way Andrej Babiš will fulfil his constitutional and legal obligations”, the statement added, stating that Pavel was ready to appoint Babiš as premier “without delay” once the matter was settled.

Business Operations and Legal Concerns

Babiš's several hundred companies, primarily under the Agrofert umbrella, function in the nation and other regional countries, benefiting from substantial funds in domestic and European agricultural and other subsidies, as well as government deals.

Under Czech law, government ministers are barred from obtaining state support or agreements. The ethics organization Transparency International has indicated that to prevent a ethical breach, Babiš must either divest, decline public contracts, or not enter public office.

Previous Term and Current Plans

Babiš affirmed he would “follow the laws” if selected as premier, but did not want to detail how in beforehand because the matter was “an highly personal and personal matter for me, and the media will invariably question me anyway”.

During his initial tenure as premier, from 2017 to 2021, Babiš faced several legal battles and an EU investigation over possible conflicts of interest. He placed his assets into trust funds, while retaining certain control over them.

A judicial body and the European Commission both ruled that this was insufficient. Babiš confirmed recently that he was again the exclusive proprietor of Agrofert and maintained he was “implementing measures” to prevent a conflict of interest, but declined to disclose details.

Governing Deal and International Implications

The billionaire populist has concluded a governing pact with two rightwing fringe parties, the ultra-conservative, pro-Russian SPD, which has advocated a referendum on leaving the EU, and the Motorists for Themselves, which has primarily opposed the EU’s Green Deal.

The new government, if approved, is expected to bolster the populist bloc in the region and could strain western support for Ukraine – although Babiš has called Ukraine’s president, Volodymyr Zelenskyy, to assure him of the nation's backing.

Pavel, who as president has a role for international relations, also requested that the government agenda include a declaration on the government’s position on Russia’s war in Ukraine, with a commitment to meeting alliance duties.

The head of state has earlier stated he would not approve any cabinet candidates who might question the Czech Republic’s EU and Nato commitments, a condition that the far-right SPD has indicated it will meet by proposing non-partisan experts.
